Please read these terms carefully
They form a legal agreement between you and Symcore Design LLC and include disclaimers and limitations of liability.
SECTION 01Agreement and Apple’s EULA
These Terms and Conditions (“Terms”) govern your download of, access to, and use of the LiveFirst iOS application and related services (collectively, “LiveFirst” or the “Service”). The agreement is between you and Symcore Design LLC, a North Carolina limited liability company (“Symcore,” “we,” “us,” or “our”), not Apple Inc.
By downloading, installing, accessing, using, creating an account for, or purchasing a subscription through LiveFirst, you agree to these Terms and acknowledge the LiveFirst Privacy Policy. If you do not agree, do not use LiveFirst.
The iOS application license is also subject to Apple’s Standard Licensed Application End User License Agreement (“Apple Standard EULA”), available at apple.com/legal/internet-services/itunes/dev/stdeula. These Terms supplement the Apple Standard EULA. If there is a conflict about the iOS app license, the Apple Standard EULA controls to the extent of the conflict. These Terms are not a replacement custom EULA.
SECTION 02Eligibility
You must be at least 13 and legally capable of entering this agreement. If you are 13 through 17, a parent or legal guardian must review and agree to these Terms and supervise your use. LiveFirst is presently offered only in the United States. You may not use it if law prohibits you from doing so.
If you use LiveFirst for an organization, you represent that you can bind it, and “you” includes that organization. LiveFirst is primarily for personal use and does not create a HIPAA business-associate relationship.
SECTION 03Account
You may register using email and password or Sign in with Apple. Provide accurate information, keep credentials and devices secure, and notify us of suspected unauthorized access. You are responsible for activity under your account unless caused by our failure to use reasonable security.
Do not impersonate another person, create an account without authority, share credentials in a way that compromises security, or use another person’s account without permission.
SECTION 04The Service
LiveFirst is a digital-wellness and productivity tool. It can help you create tasks, select rewards or a daily screen-time allowance, keep a journal, schedule local reminders, protect selected actions with an in-app parental passcode, and optionally connect a task to Apple Screen Time, HealthKit, Location Services, Calendar, or Reminders.
Some features require an Apple device, iOS 18 or later, compatible Apple frameworks, internet access, an active account, device storage, and permissions you control. A feature may not work when permission is denied or withdrawn, the operating system suspends background activity, the device is offline, a provider is unavailable, or Apple changes a framework.
SECTION 05License and ownership
Subject to these Terms and the Apple Standard EULA, Symcore grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to use LiveFirst on Apple-branded products you own or control and as permitted by Apple’s Usage Rules, for lawful personal use.
LiveFirst’s software, design, text, graphics, logos, trademarks, and Symcore-supplied content are owned by Symcore or its licensors and protected by intellectual-property law. No right is granted except the limited license above.
To the extent permitted by law, you may not copy, distribute, rent, lease, sell, sublicense, reverse engineer, disassemble, derive source code from, modify, or create derivative works of LiveFirst, or bypass access, subscription, permission, or security controls. This does not prohibit activity expressly permitted despite a contractual restriction or by an open-source license.
SECTION 06Your content
“Your Content” means tasks, titles, notes, journals, photos, goals, settings, and other content you submit. As between you and Symcore, you retain ownership.
You grant Symcore a limited, non-exclusive license to host, copy, transmit, format, display back to you, and otherwise process Your Content only as needed to operate, secure, support, and legally administer LiveFirst. This license ends when content is deleted, except for limited retention permitted by the Privacy Policy or law.
You represent that you have the necessary rights and that Your Content does not violate law or another person’s rights. LiveFirst is not a public publishing platform, and Symcore does not routinely review private tasks or journals. We may access content when reasonably necessary for support, an abuse or security investigation, legal compliance, or protection of rights and safety.
Feedback is voluntary. You grant Symcore a perpetual, worldwide, royalty-free right to use it without restriction or payment, provided we do not publicly identify you as the source without permission.
SECTION 07Acceptable use
You may not use LiveFirst to:
- Violate law, sanctions, export controls, or another person’s rights.
- Harass, threaten, exploit, stalk, defraud, or harm another person.
- Upload unlawful content or content you have no right to provide.
- Probe, scan, disrupt, overload, interfere with, or gain unauthorized access to LiveFirst, accounts, APIs, databases, storage, or providers.
- Introduce malware or automate access in an unauthorized way.
- Evade subscription controls, misrepresent purchase status, or facilitate fraud.
- Resell or commercially exploit the Service without written permission.
We may investigate suspected violations and cooperate with lawful requests.
SECTION 08Free service and LiveFirst Pro
LiveFirst may provide free and paid features. As of the Effective Date, the server-enforced free plan allows up to two tasks per day; Bronze, Silver, and Gold reward tiers; and all currently offered task completion methods and integrations, including manual, timer, Count, Journal, Calendar and Reminders, Health, and Location. LiveFirst Pro removes the daily task limit and is required to set or configure tasks as recurring or repeating. The app identifies currently included features before purchase.
Creating a parental passcode, protecting the blocked-app selection, and using the default parental-control requirements are available on the free plan. LiveFirst Pro permits separate choices for whether adding, editing, deleting, and completing tasks require the passcode. Protecting the blocked-app selection is not a separately paid Screen Time feature.
We may add, remove, or change features. We will not remove paid access already owed for a current subscription period without the remedy applicable law requires. Features can be unavailable because of compatibility, permission choices, legal restrictions, or provider changes.
SECTION 09Auto-renewing subscriptions
9.1 Purchase and plans
LiveFirst Pro is sold through Apple’s in-app purchase system. Monthly and yearly auto-renewing options may be available. Before confirmation, LiveFirst’s purchase screen and Apple’s confirmation sheet display the subscription title, duration, current localized price, included features, automatic-renewal and cancellation terms, and any introductory offer for which Apple identifies you as eligible. Those purchase-specific terms are incorporated here. Apple’s confirmation sheet controls if it conflicts with a price or offer shown elsewhere.
9.2 Trials and introductory offers
LiveFirst may offer a free trial or another introductory offer to users Apple determines are eligible. Duration and eligibility are shown before purchase. Eligibility may be limited to one introductory offer per subscription group and is not guaranteed. Unless you cancel before Apple’s displayed deadline, a free trial automatically converts to the paid subscription shown during purchase.
9.3 Billing and renewal
Payment is charged to your Apple ID account on confirmation or, for an eligible trial, when it converts. The subscription automatically renews for the selected period unless auto-renew is turned off at least 24 hours before the current period ends. Apple may charge renewal within 24 hours before the period ends. Apple may add applicable taxes.
9.4 Cancellation
Manage or cancel a production subscription through Settings > [your name] > Subscriptions or the App Store. Cancellation stops future renewal but generally does not refund the current period; Pro ordinarily continues through its end. Deleting LiveFirst, deleting the LiveFirst account, signing out, or withdrawing permission does not cancel a production Apple subscription. Cancel through Apple before deleting the account if you do not want renewal.
Apple does not allow Symcore or LiveFirst to cancel an App Store subscription on your behalf. If a production subscription is active and set to renew, the account-deletion flow warns you and links to Apple’s subscription-management screen. You may still choose to delete the account immediately, but deletion does not stop Apple billing or renewal. This warning does not apply to no-charge TestFlight sandbox purchases.
9.5 Refunds
Apple processes payments and refunds. Symcore cannot issue an App Store refund directly. Apple determines eligibility under its policies and applicable law. You may request one at reportaproblem.apple.com.
9.6 Restore and price changes
LiveFirst provides a restore-purchases function for eligible purchases. A purchase or restore requires internet access and is not allowed until LiveFirst has positively associated RevenueCat with the unique identifier for the signed-in LiveFirst account. LiveFirst refreshes and reconciles subscription status so a purchase, renewal, cancellation, or expiration can be reflected accurately. Apple handles price changes and required notice or consent. If you do not accept a required increase, the subscription may not renew.
9.7 TestFlight and sandbox purchases
In a TestFlight build, in-app purchases use Apple’s sandbox and do not incur charges. TestFlight subscriptions renew on an accelerated schedule — currently every 24 hours, up to six renewals — and then auto-renewal turns off. They expire automatically and do not require cancellation to stop real billing. Apple may change its test schedule; see Apple’s current TestFlight purchase guidance.
SECTION 10Device permissions and Apple services
You control Screen Time, Health, Location, Calendar, Reminders, Photos, and Notifications access. Permission is optional unless needed for a feature you choose. Withdrawal in iOS Settings may stop or limit that feature.
Background arrival, dwell, or departure completion requires the level of Location permission identified in the app, which is generally Always access. You may still select and save a place without that grant, but the task may require LiveFirst to remain open until the permission is enabled.
Apple services are also governed by Apple’s terms. LiveFirst does not control Apple, the App Store, iOS, HealthKit, Screen Time frameworks, Location Services, MapKit, Calendar, Reminders, Photos, or StoreKit. Apple may change, restrict, suspend, or discontinue them.
SECTION 11Wellness, health, location, and reliability disclaimers
LiveFirst is a general productivity and digital-wellness tool. It is not a medical device, healthcare service, diagnosis, treatment, therapy, crisis service, or substitute for professional medical advice. Symcore is not your doctor, and use does not create a clinical relationship. Do not use LiveFirst for an emergency or time-sensitive medical or safety decision. In an emergency, call 911 or the appropriate emergency service.
Screen Time shields, usage reports, earned-time calculations, reminders, timers, Health completions, Calendar or Reminder checks, widgets, and location completions can be delayed, inaccurate, interrupted, or fail. Causes include iOS scheduling, permissions, Low Power Mode, network or provider outages, device settings, time-zone changes, operating-system limits, region-monitor limits, corrupted data, or Apple framework changes. You remain responsible for tasks, deadlines, device use, health, travel, and safety. Do not rely on a LiveFirst notification, block, location event, or automatic completion as your only reminder, restriction, or safety measure.
Parental controls are an in-app safeguard on the signed-in device, not remote supervision, mobile-device management, age verification, or a substitute for Apple’s device-level parental controls or active adult supervision. A successful passcode entry temporarily unlocks protected actions; the app relocks when it moves to the background, and five unsuccessful attempts pause verification for 15 minutes. Automatic Health, Calendar, Reminders, Location, and timer events may complete eligible tasks without a manual passcode prompt. LiveFirst cannot prevent a person who controls the device from changing iOS settings, withdrawing permissions, deleting the app, or using other apps or devices.
SECTION 12Privacy
The LiveFirst Privacy Policy is incorporated by reference. When data practices materially change, we will update it and provide notice or obtain consent when required.

SECTION 13Third-party services and links
LiveFirst relies on Apple, Supabase, RevenueCat, and Expo and can link to Apple subscription, refund, or support resources. Their services are governed by their terms and privacy practices. Symcore is not responsible for third-party content or conduct, but this does not limit responsibility Symcore cannot lawfully disclaim for selecting or directing a provider.
SECTION 14Updates, availability, and changes
We may provide App Store or compatible over-the-air updates. Updates may add, remove, or change features and may be required for security or continued use. LiveFirst may display an operational notice, enter maintenance or unavailable mode, or require a minimum app version when needed for security, compatibility, safety, or reliable operation. If LiveFirst enters a controlled unavailable state, it may remove active Screen Time shields so selected apps are not left blocked while preserving your block-list selection for later use. Temporary network failures may be handled using a previously cached valid status or by allowing access when no reliable status is available.
We do not promise continuous, error-free, or universal compatibility. We may suspend or discontinue the Service, with reasonable notice when practicable and required by law.
SECTION 15Suspension, termination, and account deletion
You may stop and delete the account through Profile. Deletion is permanent. Review the Privacy Policy for what is deleted and what remains with Apple or RevenueCat. Account deletion does not cancel an Apple subscription.
We may suspend or terminate access if we reasonably believe you materially violated these Terms, created a security or legal risk, used the Service fraudulently, or if law requires it. When reasonable and lawful, we will provide notice and an opportunity to address the issue.
On termination, the license ends. Sections that by nature should survive, including ownership, lawful content retention, subscriptions, disclaimers, liability, indemnification, disputes, and general terms, will survive.
SECTION 16Warranty disclaimer
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LIVEFIRST IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITH ALL FAULTS AND WITHOUT WARRANTIES OF ANY KIND. SYMCORE DISCLAIMS EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, ACCURACY, AVAILABILITY, SECURITY, AND NON-INFRINGEMENT. WE DO NOT WARRANT A PARTICULAR SCREEN-TIME, PRODUCTIVITY, OR HEALTH OUTCOME OR UNINTERRUPTED OR ERROR-FREE USE.
SOME STATES DO NOT ALLOW CERTAIN DISCLAIMERS. IN THOSE STATES, THEY APPLY ONLY TO THE EXTENT PERMITTED BY LAW, AND YOU MAY HAVE ADDITIONAL RIGHTS.
SECTION 17Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SYMCORE AND ITS MEMBERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OPPORTUNITY, OR BUSINESS INTERRUPTION, ARISING FROM LIVEFIRST OR THESE TERMS, EVEN IF ADVISED THAT SUCH DAMAGES WERE POSSIBLE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SYMCORE’S TOTAL LIABILITY FOR ALL CLAIMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR LIVEFIRST IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) US $100.
THE LIMITS APPLY REGARDLESS OF THEORY BUT NOT TO LIABILITY THAT CANNOT LAWFULLY BE LIMITED, INCLUDING FRAUD OR WILLFUL MISCONDUCT. SOME STATES DO NOT ALLOW EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO PART OF THIS SECTION MAY NOT APPLY.
SECTION 18Indemnification
To the extent permitted by law, you will defend, indemnify, and hold harmless Symcore and its members, officers, employees, and contractors from third-party claims, losses, and reasonable legal fees arising from your unlawful misuse, material violation of these Terms, or infringement by Your Content. This does not apply to a claim caused by Symcore’s negligence, willful misconduct, or law violation, or where consumer law prohibits it. We will give reasonable notice; you may not settle in a way that admits Symcore’s fault or imposes obligations on it without written consent.
SECTION 19Apple-specific terms
In addition to the Apple Standard EULA:
- These Terms are between you and Symcore, not Apple. Symcore is responsible for LiveFirst and its content.
- Apple has no duty to provide maintenance or support. Symcore provides support as required by these Terms or law.
- If LiveFirst fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the app purchase price, if any. To the maximum lawful extent, Apple has no other warranty obligation.
- Symcore, not Apple, addresses claims about LiveFirst, including product liability, legal or regulatory conformity, consumer protection, and privacy, except where applicable law places responsibility on Apple.
- Symcore, not Apple, is responsible for investigating, defending, settling, and discharging a claim that LiveFirst or its possession and use infringes third-party intellectual-property rights.
- You represent that you are not in a U.S.-embargoed or terrorist-supporting country and are not on a U.S. prohibited or restricted-party list.
- You must comply with applicable third-party terms.
- Apple and its subsidiaries are third-party beneficiaries and may enforce the Apple-specific terms after your acceptance.
Questions and claims should be directed to Symcore using Section 24.
SECTION 20Governing law and disputes
Before filing a formal claim, send a written description and requested relief to admin@symcoredesign.com. You and Symcore will make a good-faith effort to resolve it for 30 days after receipt.
Except where mandatory consumer law requires otherwise, North Carolina law governs, without conflict-of-law principles. You and Symcore consent to the exclusive jurisdiction of state and federal courts in North Carolina. This does not prevent an eligible small-claims action or remove non-waivable protection under the law of your residence.
These Terms do not require binding arbitration and contain no class-action waiver.
SECTION 21Changes to terms
We may update these Terms for Service, vendor, legal, or business changes. We will revise the date and provide reasonable notice of a material change. Unless law or security requires immediate effect, a material change applies prospectively after notice. Continued use after the effective date means acceptance. If you disagree, stop using LiveFirst and cancel any subscription through Apple. Changing these Terms does not itself change an Apple price.
SECTION 22General terms
These Terms, the Privacy Policy, Apple Standard EULA, and Apple purchase terms are the entire LiveFirst agreement unless Symcore signs a separate writing. If a provision is invalid, it will be enforced to the maximum lawful extent and the rest remains effective. Failure to enforce is not a waiver.
You may not assign these Terms without consent. Symcore may assign them in a merger, acquisition, reorganization, sale of assets, or by law if the assignee assumes applicable duties. There are no third-party beneficiaries except Apple and its subsidiaries under Section 19. Headings are for convenience. “Including” means “including without limitation.” Electronic acceptance and notices have the same effect as paper where law permits.
SECTION 23Notices
We may send notices in LiveFirst, to the account email, or through the public document URL. Keep the email current. Legal notices to Symcore must be sent to admin@symcoredesign.com and are effective on receipt, subject to law.
